Terms of Service

These Terms of Service (“Terms”) govern your access to and use of https://signalflow.cards, including purchases of Signal Flow — Take One products and any related content, features, or services offered through the store.

The store is operated by Dotted Eighth LLC, doing business as Signal Flow (“we,” “us,” or “our”).

By visiting the store, placing an order, or otherwise using our services, you agree to these Terms and our Privacy Policy and Shipping & Returns Policy. Please do not use the store if you do not agree to these Terms.

1. Eligibility

You must be at least the age of legal majority in your jurisdiction, or have the permission and supervision of a parent or legal guardian, to make a purchase through the store.

By using the store, you represent that you have the legal capacity to enter into these Terms.

2. Store Platform

The store is hosted through Shopify, which provides the e-commerce technology used to offer and sell our products.

Your use of certain checkout, payment, account, or platform features may also be subject to Shopify’s terms and privacy practices.

3. Products

We make reasonable efforts to describe and display our products accurately. However:

• Screen settings may affect the appearance of colors and materials.
• Product photographs may not represent exact scale or texture.
• Physical products may contain minor variations arising from printing, cutting, finishing, or manufacturing.
• Packaging, product details, availability, and specifications may change without notice.

We do not guarantee that every description, photograph, price, or other piece of store content will be completely free from errors.

Signal Flow — Take One is a creative tool. We do not guarantee that using the deck will produce a particular creative, artistic, professional, commercial, or financial result.

4. Product Availability

Products may be available in limited quantities.

We may limit the number of items purchased by a single person, household, account, payment method, billing address, or shipping address. We may discontinue a product or restrict sales to particular regions at any time, subject to applicable law.

Placing an order does not guarantee acceptance or availability.

5. Orders

An order is an offer to purchase a product. We reserve the right to accept, reject, limit, or cancel an order for legitimate reasons, including:

• Product unavailability
• Pricing or description errors
• Suspected fraud
• Unauthorized payment activity
• Resale activity
• Shipping restrictions
• Violation of these Terms

An automated order confirmation acknowledges that we received your order. It does not necessarily mean that the order has been accepted or shipped.

If we cancel an order after payment has been collected, we will refund the canceled amount to the original payment method.

You are responsible for ensuring that your billing, shipping, contact, and payment information is complete and accurate.

6. Prices and Payment

Prices are displayed in the currency indicated by the store and may change without notice.

Applicable shipping charges, taxes, duties, and other fees will be displayed at checkout when they can be calculated by the store. International customers may be responsible for additional import taxes, customs duties, brokerage charges, or similar fees assessed by their destination country.

You agree to provide current and accurate payment information and represent that you are authorized to use the payment method submitted.

We may use third-party payment processors. We do not control and are not responsible for delays or errors caused solely by a payment provider, financial institution, or payment network.

7. Shipping, Returns, and Refunds

Shipping, delivery, return, replacement, and refund terms are described in our Shipping & Returns Policy, which forms part of these Terms.

Delivery dates are estimates unless we expressly state otherwise. Risk associated with a shipment transfers as provided in the Shipping & Returns Policy and applicable law.

Nothing in these Terms limits any mandatory return, refund, cancellation, warranty, or consumer-protection right that cannot legally be waived.

8. Personal and Commercial Use

When you purchase a physical Signal Flow — Take One deck, you may use the cards as a creative tool in your personal or professional music-making practice.

Purchasing the deck does not transfer ownership of its underlying text, prompts, design, trade dress, artwork, brand identity, instructional system, or other intellectual property.

You may not, without our prior written permission:

• Copy or reproduce the deck or a substantial portion of it
• Scan, photograph, transcribe, or distribute the complete card set
• Create or distribute a digital version of the deck
• Sell reproductions, adaptations, translations, or derivative decks
• Use the deck’s content to train or populate another prompt product, software product, dataset, or generative system
• Remove or alter copyright, trademark, or proprietary notices
• Present the deck or its content as your own product
• Use our product photographs or marketing materials for resale or commercial promotion

You may share limited photographs or brief excerpts for ordinary commentary, reviews, education, social-media discussion, or demonstration, provided the use is lawful, properly attributed, and does not substitute for purchasing the product.

9. Intellectual Property

The store and its contents, including the Signal Flow — Take One name, card prompts, written material, product design, visual identity, photographs, graphics, logos, icons, packaging, videos, audio, arrangement, and presentation, are owned by or licensed to Dotted Eighth LLC and are protected by intellectual-property laws.

“Signal Flow — Take One,” associated logos, product names, and distinctive visual elements may be trademarks or trade dress of Dotted Eighth LLC. No license to use these marks is granted except as expressly stated in these Terms.

10. Customer Content and Reviews

You may have opportunities to submit reviews, comments, photographs, suggestions, or other content.

You retain ownership of content you create. By submitting content to the store or directly to us for publication, you grant us a nonexclusive, worldwide, royalty-free, transferable, and sublicensable license to host, reproduce, edit, adapt, publish, display, and distribute that content for operating, improving, and promoting Signal Flow — Take One.

This license ends when the content is deleted from our active systems, except where continued retention is legally required or the content has already been incorporated into materials that cannot reasonably be recalled.

You represent that:

• You own the content or have permission to submit it.
• The content is accurate to the best of your knowledge.
• The content does not violate another person’s rights.
• The content is not defamatory, deceptive, unlawful, abusive, or malicious.
• The content does not contain malware, unsolicited advertising, or confidential information belonging to someone else.

We may moderate, decline, remove, or edit submitted content, but we are not obligated to do so.

11. Prohibited Conduct

You may not use the store or its services:

• For an unlawful, fraudulent, or deceptive purpose
• To violate intellectual-property, privacy, publicity, or other rights
• To submit false payment, identity, billing, or shipping information
• To interfere with the store’s operation or security
• To introduce malware, harmful code, or automated attacks
• To scrape, crawl, harvest, or systematically extract store content without permission
• To impersonate another person or organization
• To attempt unauthorized access to accounts, systems, or data
• To circumvent purchase limits or security controls
• To send spam or unsolicited commercial communications
• To harass, threaten, or harm another person
• To use the store in a manner that places an unreasonable burden on its infrastructure

We may suspend or terminate access when we reasonably believe these Terms have been violated.

12. Third-Party Services and Links

The store may contain links to or integrations with third-party services, including Shopify, payment processors, shipping carriers, analytics services, social-media platforms, and other applications.

We do not control third-party services and do not guarantee their availability, accuracy, security, or performance. Your use of a third-party service may be governed by separate terms and privacy policies.

Links are provided for convenience and do not necessarily imply endorsement.

13. Feedback

You may voluntarily send us suggestions, ideas, or feedback.

Unless we agree otherwise in writing, you understand that we may use general feedback without restriction or compensation. This does not give us ownership of your music, recordings, compositions, creative projects, or other materials merely because you used Signal Flow — Take One while creating them.

We claim no ownership of music or other creative work produced through your use of the deck.

14. Disclaimer of Warranties

To the fullest extent permitted by law, the store, its content, and our products and services are provided on an “as available” basis.

Except for warranties that cannot legally be excluded, we disclaim all express or implied warranties, including implied warranties of merchantability, fitness for a particular purpose, title, noninfringement, and uninterrupted or error-free operation.

We do not warrant that:

• The store will always be available, secure, or free from errors.
• Product descriptions or other content will always be complete or current.
• Use of the product will produce a particular creative or professional result.
• Every creative prompt will be suitable for every person, workflow, or project.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

15. Limitation of Liability

To the fullest extent permitted by law, Dotted Eighth LLC, Signal Flow, and their owners, officers, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising from the store, products, services, or these Terms.

This includes, without limitation, loss of profits, revenue, data, business opportunity, goodwill, recordings, projects, or creative work.

To the fullest extent permitted by law, our total liability for a claim relating to a product or order will not exceed the amount you paid for the product giving rise to the claim.

These limitations do not apply to liability that cannot legally be limited, including liability for fraud, willful misconduct, or certain personal injuries where applicable.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Dotted Eighth LLC, Signal Flow, and their owners, officers, employees, contractors, licensors, and service providers from claims, losses, liabilities, and reasonable expenses arising from:

• Your unlawful use of the store
• Your material violation of these Terms
• Content you submit
• Your infringement of another person’s rights
• Fraudulent or unauthorized activity associated with your account or information

This obligation does not apply to the extent a claim results from our own unlawful conduct.

17. Privacy

Our collection and use of personal information are described in our Privacy Policy.

By using the store, you acknowledge that online transmissions and transactions involve processing by Shopify and other service providers as described in that policy.

18. Changes to the Store or Terms

We may modify the store, products, features, pricing, or these Terms from time to time.

Updated Terms become effective when posted unless a later date is stated. Changes will not retroactively alter a completed purchase except where required by law or agreed with the customer.

Your continued use of the store after updated Terms become effective constitutes acceptance of the revised Terms.

19. Suspension and Termination

We may suspend or terminate access to the store when reasonably necessary to:

• Protect the store or other customers
• Investigate suspected fraud or misuse
• Comply with legal requirements
• Address a material violation of these Terms

Provisions that by their nature should survive termination will remain effective, including provisions concerning intellectual property, disclaimers, liability, indemnification, and dispute resolution.

20. Governing Law and Disputes

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles.

Subject to any mandatory consumer rights that apply in your jurisdiction, legal proceedings relating to these Terms, the store, or a purchase will be brought in the state or federal courts located in New York County, New York, and the parties consent to the jurisdiction of those courts.

21. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed if necessary. The remaining provisions will remain in effect.

22. No Waiver

A failure to enforce any provision of these Terms does not waive our right to enforce it later.

23. Entire Agreement

These Terms, together with the Privacy Policy, Shipping & Returns Policy, and any other policies expressly incorporated into them, constitute the entire agreement between you and us concerning use of the store and purchases through it.
